Welcome to Zcript, an app published by 1K Investments LLC ("Zcript," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Zcript mobile and web applications, websites, and related services (collectively, the "Service"). By creating an account, tapping "I Agree," or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
"Service" means the Zcript app and any associated software, content, AI features, websites, and tools. "User," "you," and "your" refer to the individual using the Service. "Content" means information, text, photos, AI outputs, cost estimates, repair plans, and any other material generated by or displayed within the Service. "User Data" means information you provide, upload, generate, search for, or save through the Service, including home profile details, ZIP code, photos, screenshots, repair records, search terms, and AI request inputs. "Subscription" means a paid plan offered through the Service (e.g., Zcript Pro).
By using the Service, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an entity, you represent that you have authority to bind that entity to these Terms.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes related to managing your own residential property. You may not (a) reverse engineer, decompile, or disassemble the Service; (b) resell, sublicense, or redistribute the Service or its Content; (c) use the Service to build a competing product; (d) scrape, harvest, or extract data from the Service; or (e) use the Service in any way that violates applicable law.
The Service provides general home maintenance information, self-assessment tools, cost estimates, and AI-assisted suggestions. The Service is NOT a substitute for, and does NOT constitute, a professional home inspection, engineering assessment, structural evaluation, environmental survey, pest inspection, real estate appraisal, financial advice, or legal advice. No inspector-client, contractor-client, attorney-client, or other professional relationship is formed by your use of the Service. You should consult qualified, licensed professionals before making decisions about your home.
The Service uses artificial intelligence to generate outputs including, without limitation, photo analyses, DIY repair guides, value and ROI suggestions, repair plans, quote checks, and HomeDNA assessments. AI outputs are AUTOMATED ESTIMATES that may be inaccurate, incomplete, biased, outdated, or simply wrong. AI outputs are not professional advice. Always independently verify AI outputs with a licensed professional before taking action, especially before performing repairs, hiring contractors, or making financial decisions.
Repair, replacement, ROI, project, and quote-related cost figures shown in the Service are derived from national and regional averages, third-party data sources, and AI-generated approximations. ACTUAL COSTS WILL VARY SIGNIFICANTLY based on your location, materials, labor markets, scope of work, contractor availability, permitting, and conditions specific to your property. You should obtain written quotes from licensed professionals in your area before relying on any cost figure for budgeting, financing, insurance, or transactional purposes.
If you observe or suspect any condition posing immediate danger - including but not limited to gas leaks, electrical hazards, structural instability, fire, flooding, carbon monoxide, mold contamination, asbestos, or any threat to life or property - you must IMMEDIATELY VACATE THE PREMISES and contact a qualified licensed professional or emergency services (call 911 in the United States). The Service is NOT a monitoring, alerting, or emergency-response service and must NEVER be relied upon in emergencies. Do not delay seeking professional or emergency help in order to consult the Service.
The HomeDNA safety score is a self-reported heuristic generated from your answers to questions in the Service. It is NOT a certified inspection rating, building-code compliance certification, insurance assessment, or property valuation. It has no legal, financial, or insurance significance. Do not represent the HomeDNA score to third parties (e.g., buyers, lenders, insurers) as a professional inspection result.
The Service may use ZIP code, home profile details, repair topics, and search data to help surface local contractor options, business listings, or provider information that may be relevant to your area. Zcript does not share your personal identity information, such as your email address or account identity, with local contractors so they can contact you. You are solely responsible for deciding whether to contact, hire, pay, or share information with any contractor or provider. Any relationship, communication, estimate, contract, payment, service visit, warranty, dispute, or claim between you and a contractor or provider is solely between you and that third party.
The Service may surface results, links, or content from third-party services including, without limitation, Yelp contractor results, AI providers, mapping or weather data, and external websites. We do not endorse, control, or assume responsibility for third-party services or content. Your interactions with any third party are solely between you and that third party. We are not responsible for any contractor, professional, vendor, or service provider you engage based on information from the Service.
You are responsible for the accuracy, quality, legality, and appropriateness of all User Data you submit to the Service. Do not upload sensitive information that is not needed for the requested feature. Photos, screenshots, quotes, receipts, repair notes, search data, and home profile details may be processed by Zcript and trusted service providers to provide requested features, personalize guidance, operate AI tools, maintain security, and improve the Service as described in the Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
(a) IN NO EVENT WILL ZCRIPT, ITS PARENT, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR PROPERTY DAMAGE, PERSONAL INJURY, LOST PROFITS, LOST DATA, LOST GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(b) OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE TOTAL AMOUNT YOU PAID FOR YOUR ZCRIPT SUBSCRIPTION IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) FIFTY U.S. DOLLARS ($50.00) IF YOU HAVE NOT PAID FOR A SUBSCRIPTION.
(c) THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR OTHERWISE). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE MINIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Zcript, its parent, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use or misuse of the Service; (b) your reliance on Content or AI outputs from the Service for any decision; (c) your interaction, contract, payment, dispute, or claim with any contractor, provider, vendor, or third-party service; (d) your violation of these Terms; (e) your violation of any applicable law or regulation; or (f) your infringement of any third-party right.
You are solely responsible for (a) all decisions you make based on the Service; (b) hiring qualified, licensed professionals where appropriate; (c) compliance with all applicable building codes, permitting requirements, zoning laws, HOA rules, and safety regulations in your jurisdiction; (d) the accuracy of information you input into the Service; and (e) maintaining your own backups of any data you consider important.
If you purchase a Subscription, billing is handled through the applicable app store (Apple App Store or Google Play). Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period via your app-store account settings. Refunds are governed by the applicable app store's policies. We do not provide refunds directly except where required by law.
You are responsible for maintaining the confidentiality of your sign-in credentials. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 4-15 and 17-21) will survive.
We may update these Terms from time to time. When we do, we will update the version number and prompt you to re-accept the updated Terms within the Service. Your continued use of the Service after re-acceptance constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service.
Our handling of your data is described in our Privacy Policy at https://www.homezcript.com/privacy. By using the Service you acknowledge our Privacy Policy. Zcript may use ZIP code, search data, home profile details, app activity, uploaded photos, screenshots, quote data, and AI request inputs to personalize the user experience, provide local education, operate AI features, and help surface contractor options in your area. Zcript does not sell personal information and does not share personal identity information with local contractors so they can contact you. Sensitive identifiers, such as ZIP codes, may be stored using secure storage. Backend communications are authenticated and signed.
These Terms are governed by the laws of the State of [STATE TO BE FINALIZED BY COUNSEL], without regard to its conflict-of-laws principles.
ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED BY FINAL AND BINDING INDIVIDUAL ARBITRATION administered by a recognized arbitration provider (such as JAMS or AAA) under its then-current rules. The arbitration shall take place in [VENUE TO BE FINALIZED BY COUNSEL] or, at your election, by remote/video proceedings. Judgment on the award may be entered in any court of competent jurisdiction.
YOU AND ZCRIPT EACH AGREE THAT DISPUTES MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.
You may opt out of this arbitration provision by sending written notice to zcriptsupport@1kmail.org within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.
Notwithstanding the foregoing, either party may bring an individual action in small-claims court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Zcript regarding the Service and supersede any prior agreements. You may not assign these Terms without our prior written consent; we may assign these Terms freely. No waiver of any provision will be effective unless in writing.
